The F-1 OPT to H-1B transition involves three sequential phases: OPT work authorization (12 months for all graduates, plus 24 months for STEM), followed by H-1B lottery registration in March, and H-1B employment starting October 1.

Step 1 — OPT Authorization
Optional Practical Training allows F-1 students to work for up to 12 months in a role directly related to their field of study. Most students use post-completion OPT after graduation to maximize work authorization time.

STEM OPT Extension — 24 Additional Months
If your degree is in a DHS-designated STEM field and your employer is enrolled in E-Verify, you may apply for a 24-month STEM OPT extension, giving you 36 months total of OPT work authorization and up to three H-1B lottery chances.

H-1B Preparation — Start in January
- Confirming whether the employer will sponsor H-1B. Have this conversation early — ideally before accepting a job offer. Not all employers sponsor H-1B.
- Employer engages immigration attorney. The employer hires and pays for the attorney who files the H-1B petition.
- Attorney prepares LCA. A Labor Condition Application must be DOL-certified before the petition can be filed. LCA processing takes 1–7 business days.
- Gather your documents. Passport, degree certificates, transcripts, and any professional credentials needed for the petition.
The H-1B Lottery
The H-1B cap allows 65,000 new H-1B visas per fiscal year plus 20,000 additional for US Master’s degree holders. Because demand far exceeds supply, USCIS conducts a computer lottery each March.
Cap-Gap Protection
If your OPT EAD expires between April 1 and September 30 and your employer has a timely-filed H-1B petition, cap-gap protection automatically extends your F-1 status and OPT work authorization through September 30. No additional paperwork is needed — your DSO will issue an updated I-20 reflecting the extension.
If Not Selected in the Lottery
- Remain on STEM OPT and try again next March (if remaining STEM OPT time allows)
- Consider cap-exempt employers — universities, non-profits affiliated with research, certain government organizations
- Explore other visa options: O-1A, TN (Canadian/Mexican nationals), E-3 (Australians), H-1B1 (Chilean/Singaporean nationals)
- Pursue a graduate degree to reset OPT and gain the US Master’s lottery advantage
