1. Acceptance of Terms
By accessing or using VisaPulse USA, the Employer Toolkit, or the VisaPulse USA mobile app (collectively, “the Services”), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our Services.
2. Description of Services
VisaPulse USA provides a searchable index of publicly available government filing data related to work authorization and visa sponsorship in the United States. Our data is sourced from USCIS, the Department of Labor (DOL), the Department of State (DOS), and ICE SEVIS. We present this data for informational and research purposes only.
The Employer Toolkit is a paid subscription service providing AI-powered research tools for attorneys and employers. The VisaPulse USA mobile app provides personal visa tracking tools for individuals.
3. Not Legal Advice
The information provided through our Services is for general informational purposes only and does not constitute legal advice. Immigration law is complex and varies significantly based on individual circumstances. VisaPulse USA expressly disclaims any attorney-client relationship with users of our Services. You should not rely on information from our Services as a substitute for advice from a qualified immigration attorney licensed in your jurisdiction.
4. Data Accuracy
Our data is sourced from publicly available government datasets and is updated on a regular schedule. However, we make no representations or warranties regarding the accuracy, completeness, or timeliness of the data. Government data may contain errors, may be outdated, or may not reflect the most current filing activity. Do not make legal or financial decisions based solely on data from our Services.
5. Subscriptions and Billing
Employer Toolkit is offered as a monthly subscription. By subscribing, you authorize us to charge your payment method on a recurring basis. You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. We do not offer refunds for partial billing periods.
VisaPulse USA Mobile Appoffers both free and premium tiers. Premium subscriptions are managed through RevenueCat and billed through Apple App Store or Google Play Store according to their respective terms. Refund requests for mobile app subscriptions are subject to Apple or Google's refund policies.
We reserve the right to change subscription pricing with 30 days notice to current subscribers.
6. Acceptable Use
You agree not to:
- Use our Services for any unlawful purpose
- Scrape, crawl, or systematically download data from our Services without written permission
- Attempt to reverse engineer, decompile, or extract our source code or data infrastructure
- Use our Services to build a competing product
- Misrepresent data from our Services as official government data
- Share account credentials with unauthorized users
- Interfere with the operation of our Services
7. Intellectual Property
The underlying government data displayed on VisaPulse USA is publicly available and not owned by us. However, our presentation, analysis, scoring systems, design, software, and AI-generated content are proprietary to VisaPulse USA and protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from our proprietary content without written permission.
8. Disclaimer of Warranties
Our Services are provided “as is” and “as available” without warranties of any kind, either express or implied. We do not warrant that our Services will be uninterrupted, error-free, or that any defects will be corrected. We make no warranty regarding the accuracy or reliability of any data, AI-generated content, or other information provided through our Services.
VisaPulse USA is an independent platform and is not affiliated with, or endorsed by, any U.S. government agency, including USCIS, the Department of Labor, the Department of State, or ICE. Nothing on this site constitutes legal advice or creates an attorney-client relationship. Immigration data is sourced from publicly available government datasets and may not reflect the most current government records. Processing times, filing counts, and wage data are typically published on a quarterly or annual basis and may lag current conditions.
9. Limitation of Liability
To the maximum extent permitted by law, VisaPulse USA shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our Services, including but not limited to reliance on data accuracy, decisions made based on our data, or interruption of service. Our total liability to you for any claims shall not exceed the amount you paid us in the 12 months preceding the claim.
10. Indemnification
You agree to indemnify and hold harmless VisaPulse USA and its officers, employees, and agents from any claims, damages, or expenses arising from your use of our Services, your violation of these Terms, or your violation of any third party's rights.
11. Termination
We reserve the right to suspend or terminate your access to our Services at any time for violation of these Terms or for any other reason at our discretion. You may terminate your account at any time by cancelling your subscription and ceasing use of our Services.
12. Governing Law
These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict of law principles. Any disputes arising from these Terms or your use of our Services shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules.
13. Changes to Terms
We may update these Terms from time to time. We will notify subscribers of material changes by email at least 30 days before they take effect. Continued use of our Services after updated Terms take effect constitutes your acceptance of the changes.
