What Is H-4 EAD?

H-4 EAD (Employment Authorization Document) is a work permit available to certain holders of the H-4 visa — the dependent visa for spouses and children under 21 of H-1B workers. With an H-4 EAD, the holder can work for any US employer without restriction, just like an EAD issued to someone with a pending I-485.

Unlike the H-1B itself, H-4 EAD is not employer-specific. An H-4 EAD holder can change jobs freely, work multiple jobs, start a business, or do freelance work — all without any additional immigration filings.

Eligibility Requirements

To apply for H-4 EAD, both the H-4 holder and the H-1B principal must meet specific conditions:

  • Hold a valid H-4 visa (not expired)
  • Be the spouse (not child) of the qualifying H-1B worker
  • Not have any immigration bars or inadmissibility issues
📄 H-1B Principal Must:
  • Have an approved I-140 immigrant petition that has not been revoked, OR
  • Have been granted an H-1B extension beyond the initial 6-year cap under AC21 (based on 365+ day pending I-140 or priority date more than 365 days old)

The I-140 Does Not Need to Be Filed By the Current Employer
The approved I-140 that qualifies the H-4 holder for EAD can have been filed by a previous employer, as long as it was approved and not revoked for fraud or misrepresentation. This allows H-4 EAD eligibility even after the H-1B holder has changed jobs under AC21 portability.

How to Apply for H-4 EAD

Gather Required Documents
Required documents include: the passport and H-4 visa, your H-1B spouse’s I-140 approval notice (I-797B) or proof of H-1B extension beyond 6 years, proof of your marriage, and 2 passport photos.

File Form I-765 with USCIS
File Form I-765 (Application for Employment Authorization) with the appropriate fee (currently $520 (as of early 2026)). Select eligibility category (c)(26) on the form. File at the USCIS address designated for H-4 EAD applications.

Attend Biometrics Appointment
USCIS will schedule a biometrics appointment. Attend as scheduled — missing it without rescheduling can delay your case.

Receive EAD Card
Upon approval, you receive an EAD card. It is typically valid for 2 years, though it will not extend beyond the H-4 visa validity date. Work authorization begins immediately upon receiving the card.

Processing Timeline

H-4 EAD processing times have varied significantly over the years. As of early 2026, standard processing is approximately 3–9 months. Premium processing is NOT available for I-765 H-4 EAD applications. To avoid gaps in work authorization, file your renewal well before your current EAD expires — ideally 6 months in advance.

When Your H-1B Spouse Changes Employers

When the H-1B holder changes employers, your H-4 EAD may be affected depending on how the change occurs:

  • If the I-140 that qualifies you is from the old employer: Your EAD remains valid as long as the I-140 has not been revoked for fraud. A job change under AC21 portability does not automatically revoke the qualifying I-140.
  • If the qualifying I-140 is revoked: Your EAD eligibility may be affected. Consult an attorney immediately.
  • Your own EAD card remains valid: Even if there are changes to the H-1B, your physical EAD card remains valid until its expiration date as long as the H-4 and underlying qualifying conditions remain.

Renewing Your H-4 EAD

H-4 EADs must be renewed before expiration. File Form I-765 again with updated documents. It is possible to continue working during the renewal period if you filed your renewal before the expiration date and receive a receipt notice — automatic extension rules may apply depending on current USCIS policy at the time of your renewal. Verify current automatic extension rules with your attorney.
